Your privacy is very important to us. Please read our Privacy Policy for information concerning The Outfitter Review’s collection and use of your personal information.

Credit Card

If available, certain outfitters offer the opportunity for reservations to be paid (wholly or partly and as required under the payment policy of the outfitter) to the outfitter during the reservation process by means of secure online payment (all to the extent offered and supported by your bank). Payment is safely processed from your credit/debit card or bank account to the bank account of the outfitter through a third-party payment processor.

For certain hunting or fishing tours or special offers, please note that your credit card may be pre-authorized or charged (sometimes without any option for a refund) upon reservation and confirmation of the booking. Please check the hunting or fishing tour booking details thoroughly for any such conditions prior to making your reservation.

In the event of credit card fraud or unauthorized use of your credit card by third parties, most banks and credit card companies bear the risk and cover all the charges resulting from such fraud or misuse, which may sometimes be subject to a deductible (usually set at EUR 50 (or the equivalent in your local currency)). In the event that your credit card company or bank charges you the deductible because of unauthorized transactions resulting from a reservation made on our website, we will pay you this deductible, up to an aggregate amount of EUR 50 (or the equivalent in your local currency). To be indemnified, please make sure that you report this fraud to your credit card provider and contact us immediately by email (theoutfitterreview@gmail.com).

Please state “credit card fraud” in the subject line of your email and provide us with evidence of the charged deductible (e.g., policy of the credit card company). This indemnification only applies to credit card reservations made using The Outfitter Review’s secure server and the unauthorized use of your credit card resulting through our default or negligence and through no fault of your own while using the secure server.

Further Correspondence

By completing a booking, you agree to receive (i) an email which we may send you shortly prior to your arrival date, giving you information on your hunting or fishing tour, and (ii) an email which we may send to you promptly after your hunting or fishing trip inviting you to complete our Hunter’s review form. Hunter’s Reviews and Feedback

The completed Hunter’s review may be (a) uploaded onto the relevant outfitter’s information page on our website for the sole purpose of informing customers of your opinion of the service level and quality of the hunting or fishing tour, and (b) (wholly or partly) used and placed by The Outfitter Review at its sole discretion (e.g., for marketing, promotion, or improvement of our services) on our website or such social media platforms, newsletters, special promotions, or other channels used by The Outfitter Review. We reserve the right to adjust, refuse, or remove reviews at our sole discretion.

We welcome and encourage you to provide feedback including Hunter’s reviews, comments, and suggestions for improvements to our website. You may submit feedback by emailing us at **support@bookyourhunt.com** or through the “Contact” section of the website.

Disclaimer

Our website, all content, and services provided on our website are provided on an “as is” and “as available” basis. The Outfitter Review expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and security and accuracy. The Outfitter Review makes no warranty, and expressly disclaims any obligation, that: (a) our website will meet your requirements or will be available on an uninterrupted, timely, secure, or error-free basis; (b) the content will be up-to-date, complete, comprehensive, accurate, or applicable to your circumstances; (c) the results that may be obtained from the use of our website will be accurate or reliable; or (d) the quality of any products, services, information, or other material obtained by you through the site will meet your expectations.

Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid, or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation email (whether for one event or a series of connected events).

However, and to the extent permitted by law, we (together with our officers, directors, employees, representatives, affiliates, and providers) will not be responsible or liable for (a) any damages to or viruses that may infect your computer equipment or other property as the result of your access to our website, or your downloading of any content from our website, (b) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, or loss of claim, (c) any inaccuracy relating to the information (including rates, availability, and ratings) of hunting or fishing tours available on our website, (d) the services rendered or the products offered by the outfitter or other business partners, (e) any (direct, indirect, consequential, or punitive) damages, losses, or costs suffered, incurred, or paid by you, pursuant to, arising out of or in connection with the use, inability to use, or delay of our website, or (f) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential, or punitive) damages, losses, or costs suffered, incurred, or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, wilful misconduct, omissions, non-performance, misrepresentations, tort, or strict liability by or (wholly or partly) attributable to hunting or fishing tours.

Regardless of which payment method you use, you agree and acknowledge that the outfitter is at all times responsible for the collection, withholding, remittance, and payment of the applicable taxes due on the total amount of the hunting or fishing trip price to the relevant tax authorities. The Outfitter Review is not liable or responsible for the remittance, collection, withholding, or payment of the relevant taxes due on the hunting or fishing tour price to the relevant tax authorities.

Intellectual Property Rights

Unless stated otherwise, we own our website including all of the text, images, software, trademarks, or other materials contained on our website. You will not copy or transmit any part and/or content of our website, except for your personal, non-commercial use on your computer.

The Outfitter Review, the The Outfitter Review logo, TheOutfitterReview.com (including the mobile version) are trademarks or registered trademarks of The Outfitter Review. Other product, service, or company designations on our website belong to our partners and may be mentioned on our website for identification purposes only. You should contact the appropriate partner for more complete information regarding such designations and their registration status. Your use of and access to our website does not grant you any license or right to use any of the marks included on our website.

If you provide us with feedback including but not limited to Hunter’s reviews, suggestions, ideas, ratings, or any similar or related feedback, you agree that: (a) we own the feedback and any intellectual property rights associated with it; (b) we can use and share your feedback without your consent; and (c) at our request and expense, you will execute documents and take such further acts as we may reasonably request to assist The Outfitter Review to acquire, perfect, and maintain its intellectual property rights and other legal protections for the feedback. You understand that we do not control, and we are not responsible for reviewing the feedback. However, we reserve the right to review, edit, or delete any feedback at any time.

Miscellaneous

We strive to update our website regularly, and may change the content at any time. If necessary, The Outfitter Review reserves the right, in its sole discretion, to modify, suspend, or terminate our website and/or any portion thereof, including any service or product available through our website, at any time for any reason with or without notice to you.

To the extent permitted by law, these terms and conditions and the provision of our services shall be governed by and construed in accordance with the law, and any dispute arising out of these terms and conditions and our services shall exclusively be submitted to the competent courts in Idaho, United States.

If any provision of these terms and conditions is or becomes invalid, unenforceable, or non-binding, you shall remain bound by all other provisions hereof. In such an event, such an invalid provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and you will at least agree to accept a similar effect as the invalid, unenforceable, or non-binding provision, given the contents and purpose of these terms and conditions.

FEE POLICY

The following is an explanation of all current fees imposed, or, in the case of a late fee, may be imposed by The Outfitter Review in connection with a transaction via its Services. Failure to charge any of the below fees does not constitute a waiver of the right to impose a fee at any point in time. All fees included in this policy are subject to change.

OUTFITTING FEES

The amount an Outfitter will identify in a Listing as the rate associated with the service.

SERVICE FEES

A service fee is charged on each booking to facilitate the transaction. This fee is applied to the price identified in the Listing before any coupons or credits are applied to the final bill and is non-refundable. This fee helps The Outfitter Review provide a safer and more secure booking experience, as well as dedicated customer support throughout your experience.

OUTFITTER PAYOUT

You’ll earn between 65% and 90% of the list price depending on your service and insurance plan.

PROCESSING FEES

The Outfitter Review charges processing fees on any additional payments processed on behalf of the outfitter or renter. This includes damage/security deposit payments or other miscellaneous charges. The current processing fee is 3.0% + $0.15 per charge.

ADMINISTRATIVE FEES

The Outfitter Review reserves the right to charge an additional an 8% administrative fee for various issues such as chargebacks, disputes, or late fees. This is determined on a case-by-case basis.

OUTFITTER NO-SHOW / SERVICE IN BAD CONDITION FEE

If the Outfitter does not show up at the agreed-upon start time or if the service is in an unacceptable condition, The Outfitter Review will treat this as an Outfitter cancellation and can charge the Outfitter up to $100 per no-show.

HUNTER/ANGLER NO-SHOW FEE

If the Renter is a no-show within one hour of the agreed start time, the Outfitter has the ability to cancel the booking. The Outfitter Review will treat this as a Renter cancellation. The full cancellation policy can be found here.

SECURITY DEPOSITS

A minimum of $500 will be held for each booking as a security deposit. Outfitters reserve the right to charge higher deposits, which will be held on the Renter’s credit card to cover any incidental damage or lost items. The credit card hold will be released 72 hours after the booking period ends if no dispute or claim has been filed. In the case a claim is filed by the Outfitter, the security deposit will be captured and held until the claim is resolved. If The Outfitter Review is unable to capture a security deposit before the booking, the booking can be cancelled.
For any claim event, the Renter’s security deposit will be captured to pay the insurance deductible, damages, and fees. Any portions of the security deposit that are unused will be refunded back to the Renter at the resolution of the claims process.

CHARGEBACK FEES

The Outfitter Review reserves the right to charge a $15 charge back fee to both the Renter and Outfitter depending on the type of chargeback. Additionally, Outfitters are 100% responsible for any amount disputed or charged back. When a charge back occurs, The Outfitter Review will stop payout on a booking until the chargeback is resolved. In the situation that an Outfitter has already received a payout related to a chargeback, The Outfitter Review will charge the Outfitter’s bank account for the chargeback amount and hold that amount in escrow until the chargeback is adjudicated. If the chargeback is won, The Outfitter Review will return the amount back to the Outfitter, less a $15 administrative fee. If the chargeback is lost, the money will not be returned and used to issue a refund. In this case, both The Outfitter Review and the Outfitter lose, which makes being diligent on checking for fraudulent Renters even more important.
